The Law Commission has published a report reviewing Part 2 of the Proceeds of Crime Act 2002 (POCA 2002), which includes several recommendations for reform. Some of the reforms include accelerating confiscation proceedings, giving courts the power to impose contingent enforcement orders and strengthening restraint orders and law enforcement agencies’ responses. The Law Commission has said the reforms will bolster the current confiscation regime by making it ‘faster, fairer and more effective’ and estimates reforming the current system could lead to an extra £8m in funds being retrieved from criminals in England and Wales every year.
