The European Banking Authority (EBA) has launched a consultation on draft regulatory technical standards (RTS) which set out criteria for identifying shadow banking entities for the purposes of reporting large exposures under Article 394(4) of Regulation (EU) 575/2013 (EU CRR), as modified by Regulation (EU) 2019/876 (EU CRR II). Money market funds (MMFs) under Regulation (EU) 2017/1131 (EU MMF Regulation) and alternative investment funds (AIFs) that are substantially leveraged, or not prevented from originating exposures or from purchasing third-party exposures for their own account are defined in the draft RTS as shadow banking entities. The consultation closes on 26 October 2021.
