Even if a party is entitled to an order for costs in principle, a court will use its discretion under CPR Part 44 to ensure that any costs awarded are proportionate to the matters in issue. Any doubt in relation to whether costs were reasonably incurred is resolved in favour of the paying party. In this case an application was made for £15,257 plus interest: the Court of Appeal awarded £703.77 with no interest.
