The Body of European Regulators for Electronic Communications (BEREC) has published its Opinion on Meta’s draft reference offer for WhatsApp interoperability. Meta has been designated as a gatekeeper under the EU Digital Markets Act (EU DMA) for its number-independent interpersonal communication services WhatsApp and Messenger. As such, it will be required to provide interoperability with these services pursuant to Article 7, EU DMA. In its Opinion, BEREC gave concrete proposals and insights on how to improve the draft document including a recommendation to make user consent discoverable should be explicitly given (opt-in) and to make the complete reference offer publicly available and easy-to-be-found on the gatekeeper’s website among others.
