IP analysis: In a preliminary reference to the Court of Justice, the Advocate General has opined that the posting of a photograph, freely accessible and posted on the Internet portal of a travel magazine without restrictions on use, within schoolwork contained on a school website is not a communication to the public within the meaning of Article 3(1) of Directive 2001/29/EC where there is no profit in the act and where the source of the image is indicated.
