This week's edition of Construction weekly highlights includes analysis of the Building (Higher-Risk Buildings Procedures) (Wales) Regulations 2025, publication of further regulations and guidance from the Welsh Government on building regulations in Wales, publication of guidance by the Scottish Government guidance on its Compliance Plan Approach (CPA) for high risk buildings in Scotland, launch of a consultation on the creation of a single construction regulator, a case in which the Technology and Construction Court (TCC) considered whether an adjudicator’s ‘approximate’ valuation gave rise to a breach of natural justice (Project One v VMA), and an announcement by the Construction Leadership Council (CLC) that the Office for Product Safety and Standards (OPSS) has opened applications for the Construction Products Register of Specialists.

CLC announces OPSS opens applications for Construction Products Register of Specialists

The Construction Leadership Council (CLC) has announced that the Office for Product Safety and Standards (OPSS) has now opened applications for its Construction Products Register of Specialists. OPSS, the UK regulator for construction products and consumer goods, is establishing the register to identify pre-approved experts who can be commissioned to carry out ad hoc scientific work to support its regulatory activities. The register is open to individuals with expertise in civil and structural engineering, fire science, materials science and other related areas within the natural analytical sciences and technical fields.

Welsh Government issues building regulations circulars implementing Building Safety Act 2022

The Welsh Government has issued two building regulations circulars implementing Part 3 of the Building Safety Act 2022, with both sets of regulations coming into force on 1 July 2026. The Building etc. (Amendment) (No. 2) (Wales) Regulations 2025 introduce new dutyholders and competence requirements, replace the existing "deposit of plans" system with a formal building control approval process, and establish new enforcement tools including compliance notices and stop notices with associated appeal rights. The Building (Higher-Risk Buildings Procedures) (Wales) Regulations 2025 create a comprehensive procedural framework for higher-risk buildings, requiring formal building control approval with defined timeframes of 12 weeks for new higher-risk buildings and 8 weeks for work on existing buildings. The regulations establish a change control mechanism categorising modifications as recordable, notifiable or major changes, mandate digital 'golden thread' information systems, and introduce mandatory occurrence reporting for safety incidents during construction. Both regulations include transitional provisions for work commenced or approved before the implementation date.

Scottish Government publishes guidance on compliance plan approach for high risk buildings

The Director of Local Government and Housing has published guidance on the Compliance Plan Approach (CPA) for high risk buildings verification during construction, developed in response to recommendations from the 2018 Review Panel on Building Standards Compliance and Enforcement. The guidance introduces the new Compliance Plan Manager role, to be established through legislative amendments to the Building (Scotland) Act 2003, responsible for developing and delivering compliance plans on behalf of Relevant Persons. The approach includes Construction Compliance Notification Plans, which verifiers will issue with building warrants to detail inspection stages and compliance evidence requirements. The guidance defines high risk buildings as those subject to the full compliance plan approach and establishes enhanced verification procedures intended to ensure buildings are constructed in compliance with building regulations. The document outlines roles for Building Standards Division, Local Authority Building Standards Scotland, and the Scottish Building Standards Hub in implementing the new framework.
