The European Banking Authority (EBA) has published its fourth report on the functioning of anti-money laundering (AML) and countering the financing of terrorism (CTF) colleges. The EBA has found that national competent authorities (NCAs) continued to improve the functioning of AML/CFT colleges in 2023, however, further progress is required in adjusting the functioning of colleges to the money laundering and terrorist financing (ML/TF) risks to which the underlying firm is exposed, and discussing the need for a common approach or joint action. The EBA also identified ML/TF risks to which firms of the banking, payment and e-money sectors with a FinTech-oriented business model could be particularly exposed; the EBA calls on NCAs to take these risks into consideration when supervising such firms.

The European Banking Authority (EBA) has published final guidelines that extend the existing Joint Committee Guidelines on complaints handling to credit servicers under the new Credit Servicers Directive. When handling complaints from borrowers, credit services are now required to apply the same effective and transparent procedures that have been applied for more than a decade to other firms in the banking, insurances and securities sectors.

The European Banking Authority (EBA) has published its final Guidelines on reporting requirements under the Markets in Crypto-assets Regulation (MiCA). The Guidelines aim to ensure that competent authorities receive sufficient comparable information to supervise compliance of issuers with MiCA requirements and provide the EBA with necessary information for the annual significance assessment under MiCA. They are designed to address identified reporting data gaps, promote supervisory convergence, and establish a level playing field across the European Union.

The European Banking Authority (EBA) has published two sets of final guidelines that establish common European Union (EU) standards for financial institutions to comply with EU and national sanctions. This is the first time such guidelines have been issued. The EBA has also issued own-initiative guidelines to address wider internal controls and risk management issues, based on relevant EU Directives. The new guidelines will take effect from 30 December 2025.

The European Banking Authority (EBA) has extended its guidelines on money laundering (ML) and terrorist financing (TF) risk factors (the ML/TF Risk Factors Guidelines) to cryptoasset service providers (CASPs). The new guidelines highlight ML/TF risk factors and mitigating measures that CASPs need to consider, representing ‘an important step forward in the EU’s fight against financial crime’. The guidelines will apply from 30 December 2024.

The European Banking Authority (EBA) has published a no-action letter regarding the application of the European Market Infrastructure Regulation (EMIR 3), advising competent authorities not to prioritise supervisory or enforcement action regarding applications for initial margin model authorisation under EMIR 3. The EBA has also published an opinion on the application of EMIR 3, which introduces significant changes to the regulatory landscape for Initial Margin (IM) models used in OTC derivative contracts. EMIR 3 was published on 4 December 2024 in the Official Journal of the European Union and is set to apply on 24 December 2024.

The European Banking Authority (EBA) has issued an opinion in response to the European Commission's proposed amendments to the EBA's final draft technical standards on supervisory reporting and Pillar 3 disclosures under the revised Capital Requirements Regulation (CRR3). The European Commission suggested re-including templates in the normative package for Official Journal publication, diverging from the EBA's original approach. Whilst acknowledging that the Commission's proposal maintains some flexibility, the EBA accepts it as an intermediate step.

The European Banking Authority (EBA) has published a statement clarifying the application of the third Capital Requirements Regulation (CRR 3) in the area of credit risk for the Internal Ratings Based (IRB) approach. In order to ensure a smooth operational implementation of the Banking Package, the EBA encourages institutions and competent authorities to engage in an active dialogue. Considering the strategic relevance of the targeted model landscape, institutions are in particular expected to communicate to their competent authorities the targeted model landscape that will be used from 1 January 2025 onwards.
