The European Banking Authority (EBA) has launched a consultation on its Guidelines on supervisory independence of competent authorities under the Capital Requirements Directive 2013/36/EU (EU CRD IV). The draft Guidelines reflect the introduction of new requirements in CRD IV to manage supervisory independence, including arrangements to prevent and manage conflicts of interest. The consultation closes 23 January 2026.

The European Banking Authority (EBA) is consulting on guidelines for the plans to orderly redeem asset-referenced or e-money tokens in the event that the issuer fails to fulfil its obligations under the Markets in Crypto-Assets Regulation (MiCA). The guidelines specify the content of the redemption plan, the timeframe for review and the triggers for its implementation. They are addressed to issuers of asset-referenced tokens (ART) and of e-money tokens (EMT), and to competent authorities under MiCA. Responses are sought by 10 June 2024.

The EBA will hold a virtual public hearing on the consultation paper on 16 January 2025. Responses are sought by 4 February 2025.

The European Banking Authority (EBA) is consulting on draft regulatory technical standards (RTS) to specify the conditions and the criteria to assess whether the credit valuation adjustment (CVA) risk exposures arising from fair-valued securities financing transactions are material, as well as the frequency of that assessment. The concept of materiality set out in the draft RTS will determine whether fair-valued securities financing transactions can be exempted from own funds requirements for CVA risk. Responses are sought by 8 October 2024.

Responses are sought by 8 April 2025 and a virtual public hearing will take place on 4 March 2024. Stakeholders are invited to register by 28 February 2025.

The European Banking Authority (EBA) has published a consultation paper on draft guidelines for the authorisation of third country branches (TCBs) under Article 48c(8) of Directive 2013/36/EU (CRD). The guidelines aim to harmonise the authorisation regime across Member States by specifying the information required in applications, the assessment methodology, procedural elements and standard forms and templates. They also clarify conditions under which competent authorities may rely on previously submitted information. The guidelines apply to TCBs subject to the minimum harmonisation regime under Title VI of the CRD and are designed to ensure sound and prudent management, supervisory convergence and legal clarity. The guidelines will apply from 11 January 2027, following translation into official EU languages. The consultation closes on 3 February 2026.

The European Banking Authority (EBA) has published a draft technical package for version 4.2 of its reporting framework, alongside an enhanced data point model (DPM) 2.0 semantic glossary. The package includes: (1) revisions to the Implementing Technical Standards (ITS) on resolution planning; (2) new reporting requirements under the Capital Requirements Regulation and Capital Requirements Directive CRR3/CRD6 in its common reporting framework (COREP) (operational risk own funds); (3) updates to the ITS on identifying and transmitting information on minimum requirements for own funds and eligible liabilities (MREL); and (4) changes to supervisory benchmarking for market risk. The new glossary streamlines terminology and improves consistency across reporting requirements, in line with the EBA’s June 2024 roadmap for DPM 2.0 implementation. Responses are sought by 19 September 2025, with the final package scheduled for publication in November 2025.

The proposed guidelines aim to establish criteria to assess under which circumstances, retail exposures can be considered as diversified under the credit risk standardised approach for determining capital requirements in the Capital Requirements Regulation (CRR). Responses are due by 12 February 2025.

The draft guidelines set out requirements for institutions for the identification, measurement, management and monitoring of ESG risks, including through plans aimed at addressing the risks arising from the transition towards an EU climate-neutral economy.
