TMT analysis: The Court of Justice has issued a preliminary ruling upon Article 31(1) of Directive 2002/22/EC (the Universal Service Directive) regarding whether an undertaking which offers live streaming of television programmes online must be regarded as an electronic communications network. The court held that such an undertaking was not an electronic communications network. However, the court also clarified that the Universal Service Directive does not preclude Member States from imposing ‘must carry’ obligations on undertakings which, without providing electronic communications networks, offer the live streaming of television programmes online.
