Commission publishes report assessing the EU Digital Services Act’s effectiveness

The European Commission has published a report evaluating the application of Article 33 of the EU Digital Services Act (EU DSA) and its relationship with other EU legal acts. The assessment confirms that the DSA’s designation threshold of 45 million average monthly active recipients for very large online platforms (VLOPs) and very large online search engines (VLOSEs) remains appropriate and effective for identifying services with systemic societal impact. Since its implementation, the Commission has designated 23 online platforms and two search engines as VLOPs and VLOSEs, with one designation terminated. The report finds that the framework has successfully adapted to emerging services such as Temu and Shein, confirming the DSA’s responsiveness to rapid technological change. It also concludes that the existing definitions of intermediary services sufficiently address evolving digital realities, though this may require reassessment by 2027 in light of advances such as artificial intelligence.

CMA publishes guidance on price transparency and customer consent for online charges

The Competition and Markets Authority (CMA) has published new guidance to help businesses comply with the Digital Markets, Competition and Consumers Act 2024, focusing on price transparency and obtaining express consent for additional online charges. The publications Unfair Commercial Practices: Price Transparency (CMA209) and Getting Consent for Additional Charges When Selling Online were issued following a consultation launched in July 2025, and the CMA has now published the outcome of that consultation. In addition, the CMA has updated its Unfair Commercial Practices Guidance (CMA207) to align with the new rules and ensure consistency across its consumer protection framework. Together, these updates provide a comprehensive approach to clarifying how traders must present prices and secure consumers’ active consent before charging for optional extras, strengthening protections for online shoppers and improving transparency in digital markets.

Commission launches investigations into cloud computing services under the EU DMA

The European Commission has launched three market investigations under the Digital Markets Act (EU DMA) to examine competitiveness and fairness in the cloud computing sector. Two investigations focus on Amazon Web Services (AWS) and Microsoft Azure, assessing whether they should be designated as gatekeepers, important gateways between businesses and consumers, despite not meeting the EU DMA’s quantitative thresholds for size, user numbers, or market position. The inquiries will determine whether structural features of the sector, such as interoperability limitations and data access restrictions, reinforce their market dominance. Should the Commission conclude that AWS and Azure qualify as important gateways, these services would be added to the list of core platform services already subject to DMA obligations.
