Dispute Resolution analysis: in a recent judgment, Mr Justice David Richards dismissed an application by the trustees of five discretionary trusts to discharge or vary an order for disclosure of information relating to their trusts. The order was made against the defendant in the main action (Mr Pugachev), one of the trusts’ discretionary beneficiaries, as part of a worldwide freezing order (WFO) against him that was obtained by the claimants obtained under section 25 of the Civil Jurisdiction and Judgments Act 1982 in aid of Russian proceedings. In this article we analyse the judge’s decision and highlight the key points for practitioners.
