In Gow (FC) v Grant [2012] All ER (D) 32 (Jul) the Supreme Court has said that Scottish legislative provision in relation to cohabitants does not seek to replicate the arrangements available for financial provision on divorce or the termination of a civil partnership thus for that reason it is not right to adopt the same approach — the starting points of principle are significantly different. Lady Hale also called for the reform of cohabitation in England and Wales in her supporting judgment.
