The TCC has ordered specific disclosure under CPR 31.12 and pre-action disclosure under CPR 31.16 of certain categories of documents. In doing so, it has given guidance on the principles of early and pre-action disclosure in procurement disputes (considering Mears and Sumitomo). It also made a reduction in the costs awarded to reflect the over-extensive nature of the claimant’s application.
