Alexandra Sinclair and Dr Joe Tomlinson of the Public Law Project (PLP) have published a report on Brexit and the flaws of the delegated legislation system. The authors believe the UK’s withdrawal from the EU led to a ‘tsunami’ of delegated legislation in the form of statutory instruments (SIs). The authors raise concerns surrounding, among other things, the lack of parliamentary debate, the use of Henry VIII powers, and the growing amount of SIs containing mistakes.
