Article summary
The Law Commission’s recommendations for reform to charity law, made in the 2017 Technical Issues in Charity Law report, have in most part been accepted by the government. Out of the 43 recommendations made by the Law Commission, the government has accepted 36 and has asked the Law Commission to help update the draft Bill that the Commission had produced alongside the report. The proposed reforms are expected to save an estimated £2.8m annually from the increased flexibility concerning sales of land, as well as remove unnecessary bureaucracy to allow for more efficient use of charitable funds and remove inconsistencies and complexities in the law, potentially reducing legal costs. When parliamentary time allows, the government will bring forward legislation to implement the proposed changes, which if enacted, would amend the Charities Act 2011.
