DR analysis: The Commercial Court has dismissed applications seeking to amend defences and adduce expert evidence. In doing so the court considered the Swain-Mason v Mills & Reeve criteria for determining late applications to amend. It held that, in this case, the applicant had not discharged the heavy onus on it as the proposed amendments did not give rise to a defence with a real prospect of success.
