Dispute Resolution analysis: A claimant which asserted ownership of a valuable painting has failed in its bid for permission to serve proceedings out of the jurisdiction on a defendant which also claimed entitlement to the painting. On appeal, the court considered the interpretation of CPR PD 6B, para 3.1(3) and found that although the jurisdictional gateway applied, New York was a more appropriate forum than England.
