Pensions analysis: A member of a multi-employer final salary occupational pension scheme that is closed to future accrual, but who remains in service with his or her employer and retains a link to final salary, is not in pensionable service and is therefore not an active member for the purposes of the Occupational Pension Schemes (Employer Debt) Regulations 2005, SI 2005/678 (the Employer Debt Regulations), the High Court has ruled in G4S plc v G4S Ltd. The scheme is therefore a frozen scheme for the purpose of the Employer Debt Regulations.
