This week’s edition of Environment highlights includes publication of an amendment to Regulation (EU) No 389/2013 establishing a Union Registry of transactions under the EU emissions trading system (the EU ETS Registry Regulation) in the Official Journal which provides for allowances created from 1 January 2018 by a member state which has notified its withdrawal from the EU to be identified by a country code and made distinguishable by year of creation. This week, the draft Renewable Heat Incentive Scheme Regulations 2018, which revoke the existing 2011 regulations and the draft Domestic Renewable Heat Incentive Scheme (Amendment) Regulations 2018, which amend the existing 2014 regulations, have also been published. In addition, the Supreme Court has handed down its judgment in R (on the application of Mott) v Environment Agency, concerning the legality under the European Convention on Human Rights, of licensing conditions imposed by the Environment Agency restricting salmon-fishing in the Severn Estuary. We have also updated our Practice Note on regulation of road and rail emissions.
