The Department for Environment, Food and Rural Affairs (Defra) has announced its plans to repeal the 2031 deadline for recording historic rights of way, safeguarding an estimated 40,000 miles of unrecorded paths across England. This decision will provide local authorities with additional time to assess whether paths qualify for inclusion in the ‘definitive map’, the legal record of public rights of way established by the National Parks and Access to the Countryside Act 1949. Once these rights of way are established, both local authorities and landowners will be legally responsible for their maintenance. Defra has indicated that the deadline will be repealed when parliamentary time allows.
