A party seeking to obtain a form of interim injunction, even if urgent, should notify the respondent of the details of the application unless for some reason secrecy is essential. In addition, the applicant must produce a supporting witness statement and keep a note of everything that is said between it and the judge. Copies of these documents must then be provided to the respondent. Whilst this case merely confirms the requirements set out in the CPR Mr Justice Tugendhat felt it would be helpful to highlight them in a formal judgment.
