Construction analysis: The Technology and Construction Court (TCC) was asked to grant declarations on the interpretation of the Output Specification contained in a Project Agreement and Construction Sub-Contract on the extent of the Construction Contractor’s obligations in relation to refurbishment works. Though the court for the most part sided with the Construction Sub-Contractor on its interpretation of what its scope of works consisted of, many of the declarations which were sought were resisted as the court exercised caution in interpreting the contract outside of the context of an alleged breach of contract by either party.
