What is the procedure to apply to dismiss a petition for divorce?

An application for a matrimonial order may be withdrawn at any time before it has been served by giving Notice in writing to the court where the proceedings were started (Family Procedure Rules 2010 (FPR 2010), SI 2010/2955, 7.9). See Practice Note: Amended, supplemental and further petitions (pre-DDSA 2020).

Once the petition has been served permission would be required for the petition to be dismissed or stayed. In those circumstances an application may be made following the procedure under FPR 2010, SI 2010/2955, Pt 18. See Practice Note: FPR 2010, Part 18 applications—procedure.
