Can a local authority, who has an interim care order for a child, make an application under section 33 of the Family Law Act 1986 for an order requiring disclosure of the child’s whereabouts?
Section 33 of the Family Law Act 1986 (FLA 1986) gives the court the power, where there is inadequate information as to where the child is, to order any person who it has reason to believe may have relevant information to disclose it to the court. An order under this section may be made against a person who is not a party to the proceedings, and a person is not excused from complying by reason that to do so may incriminate themselves or their spouse of an offence.
