Feed-in Tariff—checklist on issues in property transactions Feed-in tariff (FiT) The FiT scheme was introduced in April 2010 as a way of encouraging the uptake of a range of small scale renewable and low carbon electricity generation technologies (microgeneration) and applies to Great Britain. Those eligible for the FiT scheme: • are paid a specified amount for every kilowatt hour (kWh) unit of electricity they generate—the generation tariff • can (in addition) sell any surplus electricity that is exported to the grid (as opposed to consumed on site) to a licensed electricity supplier (usually the electricity supplier in respect of the site of the relevant generation facility) at a specified pence per kWh tariff—the export tariff • will (where energy is consumed on site) benefit from having lower energy bills, as they won't need to purchase as much energy from their energy supplier The FiT scheme came from powers in sections 41–43 of the Energy Act 2008. International merger control developments—January/February 2022 This month has seen the annual amendments to the merger control thresholds the US, Canada, Argentina and Nicaragua, the publication of the Competition (Amendment) Bill in Ireland and revised merger regulations in Israel. United States—revised thresholds announced The Federal Trade Commission announced the revised thresholds for notification under the HSR Act merger control regime in the United States. The new thresholds will be (in summary): • The ‘size of transaction’ (ie the value of voting securities or assets to be held) exceeds US$101m (increased from US$94.0m) and the ‘size of person’ test is met (ie one party's worldwide turnover or assets is at least US$202m (increased from US$188m)) and another party's worldwide turnover or assets is at least US$20.2m (increased from US$18.8m)), or • The ‘size of transaction’ (ie the value of voting securities or assets to be held) exceeds US$403.9m (increased from US$376m) regardless of the ‘size of person’. Delivering on delivery—government consults on build-out transparency measures

Planning analysis: On 25 May 2025, the government published a technical consultation on the implementation of a new statutory build-out reporting framework, including requirements for build out statements, commencement notices and annual progress reports for larger residential schemes, alongside a new power for local planning authorities (LPAs) to decline to determine applications due to slow build-out rates. A working paper was published alongside the consultation, inviting views on further action the government should take to speed up homes being built. This includes a proposal for a ‘Delayed Homes Penalty’ as a ‘last-resort measure’ to encourage quicker housing delivery where development falls materially behind pre-agreed build out schedules.
