Environment Agency publishes guidance on agricultural storage notification requirements

The Environment Agency (EA) has published establishing notification requirements for constructing new or substantially enlarging existing silage, slurry or agricultural fuel oil storage facilities, or storing field silage on new sites in England. The guidance requires operators to provide notification at least 14 days before commencing construction or substantial modifications. Operators must confirm that storage locations are not within 10 metres of coastal waters or inland freshwaters, and not within 50 metres of springs, wells, or boreholes. The notification process mandates the inclusion of a ten-digit National Grid reference, the site address and contact details. Operators may also optionally submit site plans, design drawings and manufacturer specifications to receive bespoke guidance.

Ofgem finalises heat networks registration guidance following consultation

Ofgem has published its decision and final registration guidance for heat networks following consultation on the draft. Stakeholders broadly supported the guidance but sought further explanation on complex and multi-party arrangements, ‘substantial control’, connected networks and proportionality for small or self-supply heat networks. Ofgem has amended the guidance by adding further detail and examples for self-supply, industrial and shared ground loop heat networks, clarifying evidence requirements and confirming registration will be managed through a digital service. The final guidance confirms a non-prescriptive, proportionate approach for networks with multiple operators, with nominated operators acting as the primary regulatory contact without assuming liability for others.

Defra publishes first England-specific habitats regulations 9A report for 2019–24

The Department for Environment, Food & Rural Affairs (Defra) has published England's first country-level assessment under regulation 9A of the Conservation of Habitats and Species Regulations 2017, SI 2017/1012 (as amended) covering conservation measures for habitats and species from 2019–24. Produced with Natural England acting on Defra’s behalf, the report fulfils the statutory six-year reporting requirement and evaluates how measures implemented on land and in the marine environment out to 12 nautical miles have supported the conservation and recovery of habitats, species and wild birds of European importance. It also assesses the impacts of these measures, the main pressures affecting biodiversity, and the monitoring and research undertaken during the reporting period.

EA publishes report on PFAS water management thresholds

The Environment Agency (EA) has published a report setting out effects-based thresholds for four per- and polyfluoroalkyl substances (PFAS) that are frequently detected in English waters: (1) perfluorooctane sulphonate (PFOS); (2) perfluorooctanoic acid (PFOA); (3) perfluorohexane sulfonic acid (PFHxS); and (4) perfluorononanoic acid (PFNA). In the absence of Environmental Quality Standards (EQSs) for other PFAS, the EA states that thresholds are needed to assess and manage environmental risks from PFAS in rivers, lakes, estuaries and coastal waters.
