The Bribery Act 2010 (BA 2010) applies to individuals as well as any business that is incorporated or trades in the UK. It covers bribery committed by an organisation, or on its behalf, anywhere in the world. BA 2010, therefore, has extraterritorial effect. It was designed to provide an effective legal framework to tackle corruption in both the public and private sectors.

Offences under BA 2010

BA 2010 criminalises:

  1. •

    bribing another person. This is often known as active bribery

  2. •

    soliciting or accepting a bribe. This is often known as passive bribery

  3. •

    bribing a foreign public official, and

  4. •

    for a business or commercial organisation only, failing to prevent bribery

The offences are discussed in more detail below. Practice Note: The Bribery Act 2010—an introductory guide introduces the offences of bribery contained in BA 2010 as well as covering territorial application, facilitation payments, gifts and hospitality, and exceptions and penalties. It also introduces the concept of having adequate procedures in place to prevent bribery by adopting the use of anti-corruption practices, as well as summarising indicators of corruption and the consequences of corruption if proven.

FCA told to reapply for warrant in lawyer fraud probe

MLex: The Financial Conduct Authority (FCA) made ‘significant errors in law’ as part of a fraud probe into a lawyer, judges have said, ordering it to reapply for a search warrant against the man. The High Court said that the FCA had not acted in bad faith and did not order the return of devices seized. In its ruling, the High Court cited messages obtained by the FCA from the lawyer, including one that said: ‘No point getting found to have committed fraud.’

Spotlight on Corruption releases manifesto on addressing environmental harm through anti-corruption measures

Spotlight on Corruption has released a manifesto setting out five consensus areas where improved anti-corruption measures can help address environmental harm. The manifesto, endorsed by 30 civil society organisations, outlines several recommendations for the government, including: (1) making more effective use of existing laws and regulations to address corruption and money laundering that enable environmental harm; (2) supporting national platforms to track climate finance, alongside enhanced reporting standards and transparency; (3) introducing comprehensive protections for whistleblowers. It also calls for reforms to the lobbying regime to prevent vested interests from delaying the transition to cleaner energy.

Senedd passes Building Safety (Wales) Bill

The Welsh Government has announced that the Senedd has passed the Building Safety (Wales) Bill. The legislation establishes a new building safety regime for residents of multi-occupied buildings across Wales, regardless of building height or tenure. The legislation, developed in response to the 2017 Grenfell Tower tragedy, is based on three core principles: (1) safety requirements, including mandating that fire risk assessments be conducted by competent persons, with criminal penalties for non-compliance; (2) accountability measures establishing clear legal responsibilities for building managers and (3) resident empowerment provisions through clearer routes to redress and increased involvement in building safety matters.
