Property Disputes analysis: The Court of Appeal considered whether a bank’s knowledge that part of a loan advanced to joint borrowers was to be applied for a purpose benefitting only one of them sufficed to engage the ‘Etridge protocol’, requiring the bank to take the steps identified by the House of Lords in Royal Bank of Scotland plc v Etridge (No 2) to avoid being fixed with notice of any undue influence which may have been exerted by one borrower on the other. The Court of Appeal held that such knowledge was not itself sufficient to engage the protocol. The court, and the bank, must look at the transaction as a whole and decide as a matter of fact and degree whether the loan was being made for the purposes of one borrower as opposed to joint purposes.
