The Humans for Rights Network, Border Criminologies and the Centre for Criminology has published a briefing raising concerns about the Border Security, Asylum and Immigration Bill's proposed expansion of criminal offences relating to irregular arrival in the UK. The briefing highlights that the new criminal offences included in the Bill build upon the Nationality and Borders Act 2022 (NABA), which introduced the offence of 'illegal arrival' and expanded 'facilitating a breach of immigration law'. Since NABA's implementation in June 2022, 556 individuals have been charged with 'illegal arrival', resulting in 455 convictions. The briefing emphasises that these prosecutions often target asylum seekers, trafficking victims, and age-disputed children, rather than smugglers. The briefing highlights that the new offences proposed in the Bill will  potentially contravene international refugee and anti-smuggling protocols. The briefing suggests that the introduction of the Bill will not prevent deaths and harm at sea, instead, it will criminalise people on the move themselves, who have no alternative route to the UK.

Construction analysis: The Court of Appeal (CoA) confirmed that the cause of action under Option 1 of the National House Building Council (NHBC) Buildmark Choice policies does not accrue on contractor insolvency—the cause of action accrues when the insured party ‘has to pay more’ to complete the building work as a result of that insolvency. The moment in time at which the insured party should be considered to be in the position of ‘having to pay more’ has been left to be determined in future proceedings.

The National House Building Council (NHBC) has outlined what residential developers need to know about ground gases when developing previously used land. It explains that gases such as methane, carbon dioxide or hydrogen sulphide may be generated by natural processes or historic waste disposal or mining work and can pose risks of explosion, fire hazards, air quality problems or asphyxiation if not properly investigated. NHBC stresses early desk research, preliminary risk assessment and appropriate gas protection measures and says its Land Quality Service can help sites meet NHBC Standards.

The National House Building Council (NHBC) has published updated versions of its Buildmark and Buildmark Choice warranty policy documents. The Buildmark warranty is intended for NHBC registered builders and owners of newly-built, newly-converted, or one off high-value homes constructed by NHBC registered builders, providing pre-completion deposit protection, a two-year builder warranty supported by NHBC's resolution service and guarantee, and an eight-year insurance policy for physical damage resulting from construction that does not meet NHBC standards. The Buildmark Choice warranty provides cover for landlords and long leaseholders of newly-built or converted homes for social rental, private rental, and shared ownership purposes. It includes features such as loss of rent cover, contaminated land protection, and policy transfer upon sale.

The New Homes Quality Board (NHQB) has published the New Homes Quality Code that introduces additional requirements for developers to fill in gaps in current protections and ensure that every aspect of a new home purchase, from when a customer walks into a sales office, through to two years after occupation of the home is covered. This new Code is outlined to protect vulnerable customers, prohibit high pressure selling, and requires any deposits the customer pays to their builder to be protected. The Code will apply to all private customers who reserve their new home from the date their developer transitions to the new arrangements. This Code also sets out ten fundamental principles which registered developers must agree to apply in their business and customer dealings, and the practical steps to consider.
