Kalayaan has published a briefing outlining suggestions for three areas of reform within immigration policy. The changes proposed comprise: extending the Overseas Domestic Worker visa from six months to twelve months and allowing the domestic worker to change employers in order to prevent exploitation; introducing a right to work for all potential victims of trafficking entering the National Referral Mechanism; and improving the accountability and monitoring of employers of migrant domestic workers.

Kalayaan has published a report titled ’12 years of modern slavery: the smokescreen used to deflect state accountability for migrant domestic workers’, which details the increase of abuse experienced by migrant domestic workers since major changes were made to the Overseas Domestic Worker (ODW) visa in April 2012. The report sets out the role and legal duties of the government to ensure that legal systems are compatible with the UK’s positive obligations to protect and safeguard all workers. Kalayaan scrutinises the ‘eight key myths’ that have been relied upon by the government as a ‘smokescreen for the state’s failure’ to protect the workforce from exploitation. Kalayaan recommends that the incoming government restores the pre-2012 visa regime with rights for migrant domestic workers to ensure their safety and dignity at work.

Private Client analysis: This was a claim by one sibling against another relating to the management of their late mother’s estate. The defendant was a former administrator of the estate. The case deals with a number of interesting procedural and substantive points. The court was primarily concerned with payments from the late mother to the defendant in unclear terms, and whether those payments constituted a gift or a loan, the distribution of jewellery owned by the estate by the defendant as executor, whether an account of occupation rent ought to be ordered and whether a purported agreement between the parties was enforceable by reason of intention to create legal relations. This case provides a number of pointers for lawyers working in this area. Written by Robert Parkin, barrister at Deka Chambers.
