PRACTICE NOTES
The JCT Major Project Construction Contract (MPCC) was created by JCT as a response to JCT contracts being heavily amended by parties for use on larger projects. It was designed to reflect the needs of experienced employers (with in-house contractual procedures) and their contractors, reflecting the commercial position as to risk allocation. It sought to reduce the need for extensive schedules of amendments to the standard terms found in the JCT Design and Build and Standard Building Contracts. The first edition published in 2003 was titled the ‘JCT Major Project Form’ and introduced some of the features now seen in other JCT forms such as the design submission procedure. It was also then included, with some changes, in the 2005, 2011, 2016 and 2024 JCT suites as the ‘JCT Major Project Construction Contract’. It is more concise than some of the other JCT forms, and leaves the particulars of several matters to be dealt with by the parties, rather than setting them out in detail in the contractual terms (such as insurance and payment). PRACTICE NOTES
The JCT Pre-Construction Services Agreement was launched in 2008. A revised edition was published in 2011 to incorporate the amendments to the Housing Grants, Construction and Regeneration Act 1996 introduced by the Local Democracy, Economic Development and Construction Act 2009, and an updated version was published in 2017 (labelled as the 2016 edition as it forms part of the 2016 JCT suite) and the latest version in 2024. This Practice Note looks at both the 2016 and 2024 editions, which are largely similar in their terms. There are two forms of the JCT Pre-Construction Services Agreement: • the Pre-Construction Services Agreement (General Contractor) (PCSA)—entered into by the ‘Employer’ and ‘Contractor’ • the Pre-Construction Services Agreement (Specialist) (PCSA/SP)—entered into by the ‘Purchaser’ and ‘Specialist’ This Practice Note focuses principally on the PCSA but the terms of the PCSA/SP are broadly the same The terms of both forms are largely similar to those commonly found in a consultant’s appointment. For more information about pre-construction services agreements in the construction industry, see Practice Note: Pre-construction services agreements. Use of the

The JCT Public Sector Supplement was first published in September 2011, with a revised version published in December 2011 to respond to the amendments to the HGCRA 1996. It is part of the JCT’s support for the implementation of the Government’s Construction Strategy (for more on which, see Practice Notes: Government Construction Strategy 2016–2020 [Archived] and Government Construction Strategy 2011–2015 [Archived]). The Public Sector Supplement can be used with most of the 2011 editions of the JCT contracts, including the most commonly used ones (ie Standard Building Contract (With Quantities, Without Quantities and With Approximate Quantities), Design and Build and Intermediate Building Contract (with and without contractor’s design)). It is free to download from the JCT website: JCT Public Sector Supplement. The Public Sector Supplement is tailored for public sector employers and their advisers. It contains suggested modifications to a number of the JCT main contracts and sub-contracts for public sector employers to address the following three issues, all of which are key features

PRACTICE NOTES
Introduction JCT published the Target Cost Contract 2024 (TCC 2024) in June 2025. The TCC 2024 was the final contract in the 2024 suite of JCT contracts. It was also the first target cost contract published as part of the JCT suite and so was not an evolution from a 2016 equivalent (as the vast majority of the 2024 contracts were). This Practice Note addresses the structure, and content of the TCC 2024 on a stand-alone basis while also providing practical tips and insight on how to use it. It also notes, where appropriate, similarities to, and divergences from, the other JCT 2024 contracts. Despite, at that time, being a new instalment for JCT, the structure, language, defined terms and concepts of the TCC 2024 will be recognisable to any reader familiar with the 2024 suite of contracts and with those from the earlier suites. The TCC 2024 is essentially a design and build contract and therefore does cover much of the same ground as the JCT Design

The Joint Contracts Tribunal (JCT) has announced its plan to unveil its new Target Cost Contract, part of the JCT 2024 Edition, at the annual Construction Industry Parliamentary Reception, being held on 13 June 2025. This contract, which includes a main contract, sub-contract, and guides, is designed for projects using target cost and difference sharing arrangements. The remuneration method involves payment of an 'allowable cost', a 'contract fee' and potentially a 'difference share'. JCT is also preparing online resources to aid users in implementing the contract. The Reception will celebrate JCT's achievements and preview these resources.
