Immigration analysis: On 12 March 2025 the Home Office issued a new Statement of Changes in Immigration Rules HC 733, together with an Explanatory Memorandum (EM). This analysis looks at the changes affecting the Skilled Worker route, which include salary changes and a new requirement for care worker/senior care worker sponsors in England to attempt to recruit from the UK ‘pool’ of displaced workers first before it can sponsor overseas workers or those in other immigration routes. The Statement also includes a new provision mandating deduction of certain aspects from what will constitute the eligible salary for meeting the relevant salary thresholds. The provision looks to be aimed at, amongst other things, arrangements whereby visa fees are loaned to an employee and then paid back over time in the form of salary deductions, as well as ‘self-sponsorship’ arrangements. However, the full intended scope will require clarification.

Immigration analysis: The Home Office has issued a substantial new Statement of Changes in Immigration Rules HC 813, along with an Explanatory Memorandum. The Statement implements many categories of the post-Brexit immigration system (termed the ‘Future Points-Based Immigration System’) and makes numerous other additions and changes to the Immigration Rules. This analysis looks at the changes to what are now termed the Intra-Company routes, due to take effect from 9 am on 1 December 2020.

The Hague Conference on Private International Law (HCCH) has held the first meeting of its Experts' Group (EG) on Digital Tokens from 16–18 June 2025. The hybrid meeting, attended by 53 delegates from 18 HCCH Members and eight Observers, focused on private international law issues related to digital tokens. The EG is to focus on two workstreams (1) the UNCITRAL Model Law on Electronic Transferable Records is to be used as a key use case study for digital trade documents and the EG will consider the feasibility of producing guidance which would complement and function alongside this and (2) the second workstream will review questions arising from the EG's issue paper which focus on jurisdiction, applicable law and the recognition and enforcement of judgments.

The Hague Conference on Private International Law (HCCH) has announced that its Experts' Group on Digital Tokens held its second meeting from 18 to 20 November 2025, attended by over 50 delegates representing 17 HCCH Members and eight Observers in a hybrid format. Under its first workstream, participants agreed to begin drafting provisions for a private international law framework on electronic transferable records, ensuring that they are fully aligned with the UNCITRAL Model Law on Electronic Transferable Records. Under the second workstream, discussions focused on stablecoins and Bitcoin as case studies to examine private international law issues raised by digital tokens, particularly regarding jurisdiction and applicable law. The Experts' Group will present a progress report to the Council on General Affairs and Policy in March 2026.

The Hague Conference on Private International Law (HCCH) held the second meeting of its Working Group on 8 October 2025 to develop a Good Practices document for the 1965 Service, 1970 Evidence, and 1980 Access to Justice Conventions. Over 60 delegates from 24 HCCH members participated in the online meeting to enhance practical operation of the conventions through streamlined procedures and increased use of information technology for cross-border cooperation. The Working Group will meet again in December 2025 to finalise the document before reporting to the Council on General Affairs and Policy in March 2026.

The Hague Conference on Private International Law (HCCH) has held the first meeting of the Working Group established to finalise a Good Practices document supporting the 1965 Service, 1970 Evidence, and 1980 Access to Justice Conventions. The Working Group, created by the Council on General Affairs and Policy in March 2025, met online on 5 June 2025 with 46 delegates from 22 HCCH Members and members of the Permanent Bureau in attendance. The meeting progressed efforts to develop a document aimed at improving the practical implementation of the Conventions, particularly through enhanced communication and the promotion of information technology. The document will serve practitioners involved in the preparation, transmission, receipt and execution of requests under the Conventions. The Working Group will continue its work and report to the Council in March 2026.

The Hague Conference on Private International Law (HCCH) has announced that the 2019 Convention on the Recognition and Enforcement of Foreign Judgments in Civil or Commercial Matters entered into force for the United Kingdom on 1 July 2025. This follows the UK's ratification of the Convention on 27 June 2024.

The Hague Conference on Private International Law (HCCH) has announced that the Council on General Affairs and Policy (CGAP) met from 3 to 6 March 2026 with 560 participants, from HCCH Members, non-Member States, intergovernmental and international non-governmental organisations. CGAP approved decisions on several legislative instruments, advancing the work on a potential convention on legal parentage and clarifying jurisdiction issues for transnational litigation. The meeting also directed further work on digital economy concerns, including digital tokens, CBDCs, and the development of electronic transferable records. CGAP elected a new Chair, amended procedural rules, and stressed enhanced cooperation with international bodies.

The Hague Conference on Private International Law (HCCH) has launched a public consultation on the draft text of a possible new convention addressing parallel proceedings and related actions in cross-border civil and commercial litigation. Announced on 18 November 2025, the consultation invites input from judges, practitioners and experts worldwide on whether the draft would improve legal certainty, predictability and access to justice by reducing inconsistent judgments and litigation costs. Feedback will inform discussions at the March 2026 meeting of the Council on General Affairs and Policy, which will determine the project’s next steps. The consultation runs from 18 November 2025 to 26 January 2026.
