Much of the work conducted throughout a probate matter consists of notifying individuals and institutions of the deceased’s death, requesting valuations and other information, submitting the grant of representation and collecting in the assets. Consequently practitioners often need to replicate the same letter, or a minor variation of the same, over and over again. Many of the requests for information are standard documents and these Precedents can be used as they stand or altered or added to as the circumstances demand. In some cases, institutions will have their own procedures for requesting information and closing accounts and this information can often be found on their website. The wording for the application to lead to the grant of representation will need to be tailored to the precise circumstances and a selection of the many available Precedents are included below. The rules relating to case management and directions in the fast track vary, depending on whether proceedings were issued before or after 1 October 2023. Provisions relating to case management of claims on the fast track are largely contained in CPR 26, CPR PD 26, CPR 28 and CPR PD 28 and these provisions were amended with effect from 1 October 2023. This Practice Note only considers case management of fast-track claims for civil proceedings issued before 1 October 2023. For information on case management of fast-track claims for proceedings issued on or after 1 October 2023, see Practice Note: Fast track—case management—position on or after 1 October 2023. Note however that for personal injury claims, the rules vary depending on the date when the cause of action accrues and for disease claims when the first letter of claim has been sent.
