The Financial Conduct Authority (FCA) has announced plans to consult on extending the timeframe for motor finance firms to handle commission-related complaints and for consumers to refer such complaints to the Financial Ombudsman Service (FOS), following Court of Appeal ruling in Hopcraft v Close Brothers Ltd, Johnson v Firstrand Bank Ltd and Wrench v Firstrand Bank Ltd that brokers (car dealers) receiving commission from lenders without customers' informed consent was unlawful. The consultation proposals are expected within two weeks, aiming to have the complaint extension in place by mid-December 2024 to prevent disorderly outcomes amidst an anticipated surge in complaints.

The Q&A asks whether spread bets can be reported at position level only (ie not as individual transactions), with the provisional answer being yes, provided the relevant conditions in Article 5 of the Technical Standards on the Minimum Details of the Data to be Reported to Trade Repositories are met. Responses are sought by 23 July 2024.

The Financial Conduct Authority (FCA) has published consultation paper CP25/23: Deferred Payment Credit (unregulated Buy Now Pay Later): proposed approach to regulation. The FCA is seeking feedback on rules and guidance that it proposes to apply to deferred payment credit (DPC) lending (which is distinct from Buy Now Pay Later), following the government’s decision to bring this under FCA regulation. The CP includes proposals for firms to give information to consumers and undertake creditworthiness assessments, and asks whether the FCA should apply existing rules for regulated credit activity to this sector. Responses are sought by 26 September 2025.

Following the government’s draft UK Sustainability Reporting Standards (UK SRS), consultation paper CP26/5 seeks views on replacing the FCA’s current Task Force on Climate-related Financial Disclosures (TCFD)-aligned listing rules with requirements for in-scope listed companies to report against UK SRS. The Financial Conduct Authority (FCA) has published Consultation Paper CP25/30, seeking views on proposals to streamline the UK EMIR Intragroup Regime alongside HM Treasury’s proposed legislative changes to the Intragroup Regime set out in its draft SI, the Over the Counter Derivatives (Intragroup Transactions) Regulations 2026. CP25/30 sets out the FCA’s proposals to implement these changes alongside additional changes to consolidate the regime and reduce burdens on counterparties. Responses are requested by 16 January 2026. The FCA will publish a policy statement and final rules once the draft SI is finalised.
