Law360: The Financial Conduct Authority (FCA) has said it is planning a new 'traffic light' guide for retirement investment plans as it seeks to improve long-term value in workplace pensions, shifting the emphasis for providers from a simple consideration of costs.

Pensions analysis: On 11 December 2025, the FCA published Consultation Paper CP25/39, ‘Adapting our requirements for a changing market.’ The FCA regulator is reviewing its pension rules because the market is now heavily dominated by defined contribution (DC) savings, and individuals are taking on more responsibility for managing their retirement. With DC assets now greater than those in defined benefit (DB) schemes, the FCA believes the current framework may no longer give consumers enough support to make informed decisions. The consultation is open until 12 February 2026, and the FCA plans to issue final rules in the second half of 2026.

The Financial Conduct Authority (FCA) is consulting on changes to its Payment Services and Electronic Money Approach Document to support new legislation to tackle authorised push payment (APP) fraud. HM Treasury has proposed amendments to the Payment Services Regulations 2017 to enable payment service providers (PSPs) to delay making a payment transaction where they have reasonable grounds to suspect fraud or dishonesty. The policy aims to increase firms’ ability to tackle APP fraud while minimising the impact on legitimate payments. In GC24/5 the FCA sets out how PSPs should apply the legislative changes to minimise the impact on legitimate payments. Responses are sought by 4 October 2024. The Payment Systems Regulator (PSR) has also published Specific Direction 21 (SD21), which includes the APP scams reimbursement requirement and directs in-scope PSPs to comply with the reimbursement rules.

The Financial Conduct Authority (FCA) has published consultation paper CP25/34: ESG ratings: proposed approach to regulation, setting out proposals to ensure that environmental, social and governance (ESG) ratings are ‘transparent, reliable and comparable’. The proposals follow the decision by the government to bring ESG ratings within the FCA’s remit. Responses are sought by 31 March 2026.

The Financial Conduct Authority (FCA) has launched a consultation paper (CP25/26) proposing additional changes to its Handbook rules to implement its targeted support framework. The consultation follows CP25/17, which established a framework enabling firms to provide tailored suggestions to consumer groups with shared characteristics. Feedback is sought by 17 October 2025, with final rules expected in December 2025.

The Financial Conduct Authority (FCA) has launched its 46th Quarterly Consultation, proposing regulatory changes across several sectors. A key proposal includes updating the FCA’s Handbook to align with the new edition of the UK Corporate Governance Code, published by the Financial Reporting Council (FRC) in January 2024 (the 2024 Code). This includes removing specific references to FRC guidance in the UK Listing Rules (UKLR) and Disclosure Guidance and Transparency Rules (DTR) sourcebooks, along with introducing transitional provisions for UKLR and DTR implementation. The FCA also proposes updating the Code's definition in the Handbook’s Glossary, as well as updating references to the Code’s guidance in the Systems and Controls sourcebook (SYSC), Code of Conduct sourcebook (COCON), Statements of Principle and Code of Practice for Approved Persons sourcebook (APER), and the Decision Procedure and Penalties manual (DEPP). The FCA considers the impact of these proposals to be minimal, and therefore, a detailed cost benefit analysis is not required. The consultation closes on 27 January 2025, with the FCA intending to implement these changes promptly after the consultation and Board approval, without a transition period, as companies subject to the Code are expected to be familiar with the updates.

The Financial Conduct Authority (FCA) is seeking feedback alongside the Bank of England (BoE) on draft guidance (in the form of Q&As) for reporting under the revised UK EMIR Article 9 reporting requirements. Responses are sought by 28 March 2024. A further consultation on the Q&As will be published in spring 2024.

The Financial Conduct Authority (FCA) has published a discussion paper (DP25/1), inviting stakeholder feedback on its proposed regulatory framework for cryptoassets. The paper sets out proposals for the regulation of cryptoasset trading platforms, intermediaries, staking arrangements, lending and borrowing practices, and decentralised finance, as well as the use of credit in the purchase of cryptoassets. The FCA aims to establish a safe, competitive, and sustainable cryptoasset sector by providing firms with the necessary regulatory clarity, thereby promoting market integrity and ensuring appropriate consumer protection. Responses are sought by 13 June 2025 with the FCA intending to consult on the final regime later in the year after it has considered the feedback from this discussion paper.
