The European Commission is seeking feedback on the functioning of the EU’s regulatory framework on cryptoassets, the Markets in Crypto Assets Regulation (MiCA). Responses are sought by 31 August 2026, and will be used to assess whether the current framework remains fit for purpose, and to inform the Commission's future policy work on digital assets.

The European Commission has sent requests for information (RFI) to Pornhub, Stripchat, and XVideos under the EU Digital Services Act (EU DSA). The requests focus on their transparency reporting obligations, content moderation practices, and public advertisement repositories. The platforms must respond to the RFIs by 7 November 2024. Any failure to comply may lead to formal proceedings under Article 66 of the EU DSA and incorrect or misleading information can lead to penalties and fines under Article 74(2) of the EU DSA.

The European Commission has sent formal requests for information (RFIs) to Temu and Shein, which are online marketplaces pursuant to the EU Digital Services Act (EU DSA). The Commission is requesting further information on the measures the two online marketplaces have taken to comply with the EU DSA obligations regarding the 'Notice and Action mechanism' that allows users to notify illegal products, the online interfaces which should be designed to not deceive or manipulate users through 'dark patterns', the protection of minors, the transparency of recommender systems, the traceability of traders and compliance by design. Temu and Shein are required to provide RFIs by 12 July 2024. The Commission will examine the next steps based on the online marketplaces response, which could include formal opening of proceedings under Article 66 of the EU DSA.

The European Commission has sent a Statement of Objections to Alchem International Pvt Ltd and its subsidiary Alchem International (H.K.) Limited (together 'Alchem') of its initial view of breaching EU antitrust rules by participating in a long-term cartel regarding an key pharmaceutical product. Alchem was the seventh company the Commission opened proceedings against. Alchem was not covered by the October 2023 settlement decision, and therefore the investigation concerning this company continued under the standard (non-settlement) cartel procedure.

The European Commission has sent X a request for information under the EU Digital Services Act (EU DSA) to provide detailed information and internal documents on its content moderation resources since X has reduced its linguistic coverage within the EU from 11 EU languages to 7. The Commission also seeks further information on X’s risk assessments and mitigation measures linked to the impact of generative AI tools on electoral processes, dissemination of illegal content and protection of fundamental rights. X must provide the information to by 17 May 2024, and to the remaining questions by 27 May 2024. The Commission can impose fines and penalties for incorrect, incomplete or misleading information and for a failure to reply, pursuant to Article 74(2) of the EU DSA.

The European Commission has sent TikTok a request for information under the Digital Services Act (DSA), asking for more details on the risk assessment the provider of TikTok should have carried out before deploying the new app TikTok Lite in the EU. This concerns the potential impact of the new 'Task and Reward Lite' programme on the protection of minors, as well as on the mental health of users, relating to the potential stimulation of addictive behaviour. The Commission is also requesting information about the measures the platform has put in place to mitigate systemic risks. TikTok must provide the risk assessment for TikTok Lite in 24 hours and the other requested information by 26 April 2024.

The European Commission has adopted a package of infringement decisions as a result of the failure of Member States to communicate the measures taken to transpose certain Directives into national law. A formal letter of notice has been sent to 26 Member States who have not yet notified full transposition measures for 11 Directives dealing with, among others, the EU Emissions Trading System (EU ETS), legal migration, the protection of whistleblowers and credit services. The Member States have two months to reply to the letters of formal notice and complete their transposition, otherwise the Commission can issue a reasoned opinion.

The European Commission has sent notice letters to 26 Member States for failing to transpose Directive 2022/2555 (the NIS2 Directive) on cybersecurity and Directive (EU) 2022/2557 (the CER Directive) on the resilience of critical entities.

The European Commission has sent AliExpress a formal request for information on the measures it has taken to comply with its obligations as a Very Large Online Platform, under the EU Digital Services Act (EU DSA). In particular, the Commission wants to investigate AliExpress’ assessment and mitigation measures to protect its consumers from illegal products such as fake medicines being sold online. AliExpress’ deadline to submit the information is 27 November 2023. The Commission can impose fines for incorrect, incomplete, or misleading information provided by AliExpress, pursuant to Article 74(2) of the EU DSA. Based on the assessment of AliExpress’ replies, the Commission will assess next steps which can include formal proceedings under the EU DSA.

The European Commission has sent requests for information to six Very Large Online Platforms (VLOPs) and two Very Large Online Search Engines (VLOSEs) under the Digital Services Act (DSA). These requests, sent to Facebook, Instagram, Snapchat, TikTok, YouTube, X, Bing and Google Search, ask for more information on the ways in which these platforms are addressing risks associated with generative AI, including issues such as false information dissemination, deepfakes, and service manipulation. The Commission has requested to obtain internal documents related to risk assessments and mitigation strategies concerning a variety of areas such as electoral processes, illegal content distribution and fundamental rights protection. These VLOPs and VLOSEs must provide the requested information by 5 April 2024, and failure to provide this information accurately and on time may result in fines or penalty payments.

The European Commission services has opened a targeted consultation seeking information from relevant stakeholders regarding the application and effects of the specific liability regime laid out in Article 17(6) of Directive (EU) 2019/790 on copyright and related rights in the Digital Single Market (EU DSM Copyright Directive). Article 17 of the EU DSM Copyright Directive established rules that apply to online content-sharing services providers for the content uploaded by their users. Article 17(6) introduced a lenient regime for service providers with a turnover below €10m and available to the public in the EU for less than three years. The targeted consultation forms part of Commission’s analysis of the lighter liability regime in Article 17(6), required under Article 30(1) of the EU DSM Copyright Directive. The consultation will close on 7 June 2024.

The European Commission has signed an agreement with the European Union Intellectual Property Office (EUIPO) to strengthen intellectual property rights enforcement under the Digital Services Act (DSA). The partnership is designed to enhance the Commission's capabilities to address systemic intellectual property (IP) risks posed by very large online platforms and search engines, including the spread of counterfeit goods and online piracy content. Under this agreement, EUIPO will expand its efforts to combat IP by collaborating with judicial and enforcement authorities, online intermediaries, and IP rights holders.
