Assistant US Trade Representative Adam Hodge has released a statement on the four World Trade Organization (WTO) panel reports released on Certain Measures on Steel and Aluminum Products (DS544, 552, 556 and 564). Hodge stated that the US ‘strongly rejects the flawed interpretation and conclusions’ in the challenges to the section 232 tariffs imposed by former US President Donald Trump and confirmed by current US President Joe Biden. The US’s position is that GATT article XXI national security exceptions cannot be reviewed in WTO dispute settlement proceedings, and for this reason, it will not remove the section 232 duties as a result of these panel reports.
