The Court of Appeal in making no order as to costs meant that not only did the successful defendants not receive their costs in relation to the unsuccessful defences put forward but they were also deprived of costs on the one issue they did win. The Court of Appeal stated that it considered this approach to be one in which the defendants paid 'the appropriate price to be paid for profligacy'.
