The Mental Welfare Commission for Scotland has published a report on the use guardianship orders in Scotland in relation to the Adults with Incapacity (Scotland) Act 2000. The data shows that a total of 3,199 guardianship orders were granted in the year 2019–2020, which is a seven per cent increase on the previous year. Most of the guardianship orders granted in 2019-2020 were for individuals who either have a learning disability (49%), or dementia/Alzheimer’s disease (36%). In addition, the report includes example case studies of some individuals the Commission visited, views from both people subject to guardianship orders and their guardians. Overall, the Commission concluded that there is 'a continued rise in the use of guardianship orders in Scotland'.
