Dispute Resolution analysis: The High Court decided that the claimant and third party’s costs budgets of £1.5m each were disproportionate in relation to the claimant’s trespass claim against the defendant and the defendant’s competition law counterclaim against the claimant and a Part 20 claim against the third party. After the budgets had been produced, the defendant indicated that the likely damages would be in the region of £80,000–120,000. The court therefore directed the claimant and third party to file revised budgets not exceeding £800,000 each. Andy Creer, barrister at Hardwicke, examines the court’s decision.
