Article summary

The Court of Appeal has amended its previous decision made in July of this year which increased general damages by 10% to all civil claims decided after 1 April 2013. That will not now apply if the case is funded by way of a CFA entered in to before 1 April 2013. The court has also taken the opportunity to clarify the further type of damages to which the 10% increase will apply as well as pain, suffering and loss of amenity i.e. physical inconvenience and discomfort, social discredit, mental distress and loss of society of relatives.
