Environmental permitting regime

Large installations and polluting processes are subject to integrated pollution prevention and control under the Environmental Permitting (England and Wales) Regulations 2016 (EPR 2016), SI 2016/1154. These Part A(1) and Part A(2) activities have an ‘integrated’ approach regulating emissions to all environmental media—air, water and land.

The Environment Agency (EA) and Natural Resources Wales (NRW) regulate Part A(1) activities and installations listed in EPR 2016, SI 2016/1154, Schedule 1, Part 2. Part A(1) activities include:

  1. combustion activities over 50 megawatts

  2. large refining operations

  3. melting mineral substances exceeding 20 tonnes per day

  4. producing organic chemicals

  5. disposal of waste by landfill receiving more than 10 tonnes of waste per day (other than inert waste)

Local authorities regulate Part A(2) activities and installations listed in EPR 2016, SI 2016/1154, Sch 1, Pt 2. These activities are often referred to as Local Authority Integrated Pollution Prevention and Control (LA-IPPC). Part A(2) activities include:

  1. surface treating metals

  2. glass manufacturing

  3. animal waste incineration

  4. new tyre manufacturing
