Energy Savings Opportunity Scheme (ESOS)

ESOS is an energy assessment and energy savings scheme. It is mandatory for organisations that meet the qualification criteria. It derives from the EU Energy Efficiency Directive 2012/27/EU, art 8(4)-(6), which requires EU Member States to ensure that enterprises that are not small and medium-sized enterprises (SMEs) are subject to an energy audit carried out at least every four years.

The requirements of the Energy Efficiency Directive, art 8(4)–(6) were implemented in the UK through the Energy Savings Opportunity Scheme Regulations 2014 (ESOS Regulations), SI 2014/1643. The Energy Act 2023 has granted powers to make necessary changes to ESOS post-Brexit, and the Energy Savings Opportunity Scheme (Amendment) Regulations 2023, SI 2023/1182 have made changes in advance of the Phase 3 compliance deadline.

Organisations that qualify must undertake an energy assessment and audit of their total energy consumption. In most cases the audit needs to be conducted or reviewed by a 'lead assessor', who must be a member of a professional body approved by the Environment

Law Society publishes technical note on physical climate risks

The Law Society has published a technical note on physical climate risks, providing additional guidance for solicitors and their clients on how these risks may impact UK properties. The note covers risks such as coastal erosion, ground stability, heat stress and heat exposure, and wildfires, among other aspects. It supplements the Law Society’s climate change and property practice note, published on 12 May 2025.

OEP finds potential breaches of environmental law on wild bird protection by Defra and Natural England

The Office for Environmental Protection (OEP) has found potential breaches of environmental law by the Department for Environment, Food and Rural Affairs (Defra) Secretary of State and Natural England concerning the protection of wild birds. As a result, the OEP has issued information notices to both bodies, detailing its findings. They have until 5 August 2025 to respond, after which the OEP will review the responses before determining next steps. This follows an investigation launched by the OEP in March 2024. A parallel investigation is ongoing in Northern Ireland, with an information notice also issued to the Department of Agriculture, Environment and Rural Affairs.

MMO consults on proposed fishing management measures in 42 MPAs

The Marine Management Organisation (MMO) has launched a consultation on proposed fishing management measures across 42 marine protected areas (MPAs) in English waters. The proposals include four new regional byelaws that would: (1) ban the use of bottom towed gear across approximately 30,000 km2; (2) prohibit the use of traps across 860 km2; and (3) prohibit the use of bottom set nets and lines across 300 km2. The byelaws, covering the Eastern Channel, Irish Sea, North Sea, and Western Channel and Southwest regions, would replace all previous MMO MPA byelaws. This consultation forms part of Stage 3 of the MMO’s wider project to manage fishing activities in all English offshore MPAs and focuses on seabed features in MPAs that are not yet protected by existing MMO byelaws. The consultation closes on 1 September 2025.
