Environmental impact assessment

Purpose of EIA

An environmental impact assessment (EIA) is an assessment of a project's likely significant environmental effects. It enables significant effects on the environment to be given due weight, along with economic or social factors, when planning applications are being determined, and provides an opportunity for negative environmental effects to be reduced or mitigated where possible. It also gives the public and other consultees opportunities to participate in the decision-making procedures of consents which affect the environment. Legislation and guidance

In a town and country planning context, the EIA process is governed by:

the Town and Country Planning (Environmental Impact Assessment) Regulations 2017, SI 2017/571 (the English EIA Regulations) in England, and
•
the Town and Country Planning (Environmental Impact Assessment) (Wales) Regulations 2017, SI 2017/567 (the Welsh EIA Regulations) in Wales

Environment weekly highlights—4 September 2025

This week's edition of Environment weekly highlights includes: news analyses on the International Court of Justice (ICJ)'s first advisory opinion (AO) clarifying states' legal obligations relating to climate change, the UK's first claim under the International Centre for Settlement of Investment Disputes (ICSID) Convention showing bilateral investment treaty reach and the case of Smar v Secretary of State for Environment and Rural Affairs, relating to planning considerations and felling control. In addition this week, the Department for Energy Security and Net Zero (DESNZ) has published a policy overview of the UK Emissions Trading Scheme (UK ETS), detailing recent developments and upcoming changes and the Home Office has introduced a modern slavery optional international reporting template. Further this week, Spotlight on Corruption has published an analysis calling for the UK to establish a dedicated sanctions regime targeting environmental crimes.

OEP publishes response to Defra’s Offshore Wind Compensation consultation

The Office for Environmental Protection (OEP) has published its response to the Department for Environment, Food and Rural Affairs (Defra)’s July 2025 Offshore Wind Compensation consultation, highlighting both positive elements and potential environmental risks. The OEP cautioned that removing network coherence requirements and allowing compensation measures across different protected sites could lead to a fragmented reshaping of the Marine Protected Area (MPA) network. It also called for clearer guidance on compensation measures and sought clarification that industry funding would not be used to fulfil government obligations for MPA management. The OEP's Chief Regulatory Officer, Helen Venn, welcomed certain aspects of the proposed approach—including the continued integration of monitoring, the establishment of a public compensation register, adaptive management and the mitigation hierarchy. The OEP further called for greater transparency on how the Environmental Principles Policy Statement is informing the development of offshore wind compensation.

Council of the EU adopts position on CAP simplification package

The Council of the EU has adopted its position on the Commission’s ‘Omnibus III’ legislative package, aimed at simplifying the Common Agricultural Policy (CAP) to enhance the competitiveness of European agriculture. The package amends the key CAP regulations to reduce administrative burdens, improve support for small and organic farms, and streamline compliance procedures. The Council endorsed measures expected to generate annual savings of up to €1.6bn for farmers and over €200m for national administrations, while also introducing greater flexibility for member states, enhanced risk management tools, and increased advance payments for farmers affected by crises. Negotiations with the European Parliament will follow once it adopts its position, with the initiative forming part of a broader EU strategy to reduce regulatory burdens and improve operational conditions across sectors.

Defra publishes supplementary guidance on recyclability assessment methodology

The Department for Environment, Food and Rural Affairs (Defra) has published supplementary guidance providing additional detail and clarification on the recyclability assessment methodology (RAM) for producers obligated under the extended producer responsibility (EPR) for packaging scheme. The guidance covers 27 technical areas, including medical packaging classifications, distributor responsibilities, testing protocols and record-keeping obligations. It supplements, but does not replace, the existing RAM framework and will be updated more frequently than the annual RAM revisions if further clarification is needed.
