Court of Appeal considers asymmetrical jurisdictional clauses (Hipgnosis v Manilow)

Dispute Resolution analysis: This case provides an analysis of asymmetrical jurisdiction clauses in the context of a dispute arising from the sale of the back catalogue of Mr Barry Manilow. It serves as a reminder that the jurisdiction of the English Courts is determined at the date of issue of proceedings. The concept that the English court had jurisdiction when the proceedings were issued, but that was ‘floating’ and was lost in favour of California when the option to sue there was exercised, was heretical and contrary to authority. Ofgem launces statutory consultation to modify NESO licence and enhance onshore transmission tendering

Ofgem has launched a statutory consultation which seeks to amend the National Electricity System Operator’s (NESO) licence by introducing new obligations (which include submitting Tender Documentation for Ofgem’s approval), providing information to bidders, complying with the Onshore Competition Information Exchange Guidance, and ensuring that tender exercises are conducted efficiently and effectively. Stakeholders are invited to submit feedback on these proposed changes via email: onshorecompetitionspolicy@ofgem.gov.uk, until the 3 June 2025.

This week's edition of Energy weekly highlights includes: news analysis on Ofgem's approval of the TMO4+ grid connection reforms package, the Department for Energy Security and Net Zero (DESNZ)'s publication of an open letter announcing funding through GB Energy for domestic offshore wind supply chains, along with an amendment to the GB Energy Bill adding measures against slavery and human trafficking, and DESNZ's call for evidence on civil and defence nuclear regulatory framework. In addition this week, DESNZ launched a consultation on revenue support regulations for greenhouse gas removals and power bioenergy with carbon capture and storage (BECCS) business models, DESNZ's publication of its response to the Smart Secure Electricity Systems Programme consultation, Ofgem's publication of its consultation decision on revised special conditions for transmission licences and DESNZ's consultation launch on revised National Policy Statements for energy infrastructure.

Ofgem publishes consultation on fair pricing protections for heat networks regulation

Ofgem are consulting on proposals for the structure, objectives and principles of a fair pricing framework for heat networks. This consultation closes on 9 July 2025.
