CJEU upholds nuclear and gas inclusion in sustainable investment taxonomy

The Court of Justice of the European Union (CJEU) has dismissed Austria's challenge to Commission Delegated Regulation (EU) 2022/1214, which classifies certain nuclear and fossil gas activities as sustainable investments under the Regulation (EU) 2020/852. Austria argued that these sectors should not be considered environmentally sustainable due to their associated risks and environmental impacts. However, the Court held that the Commission acted within its delegated powers and was entitled to conclude that, under specific conditions, nuclear and fossil gas activities can contribute meaningfully to climate change mitigation and adaptation. It emphasised that nuclear energy produces near-zero greenhouse gas emissions and that no economically viable low-carbon alternatives currently exist at sufficient scale to meet continuous energy demand.

EU Parliament approves EU CBAM simplification with new de minimis threshold

The European Parliament has approved amendments to the EU Carbon Border Adjustment Mechanism (EU CBAM) by 617 votes to 18, with 19 abstentions. The changes, part of the 26 February 2025 ‘Omnibus I’ simplification package, introduce a new 50-tonne per importer annual threshold exempting 90% of importers, mainly SMEs and individuals, while still covering 99% of CO2 emissions from iron, steel, aluminium, cement and fertiliser imports. The amendments simplify authorisation, emissions reporting and verification processes, and strengthen anti-abuse measures. The text requires Council endorsement and will apply three days after publication in the EU Official Journal.

Ofgem publishes decision on DCC Successor Licensee operational model and objectives

Ofgem has published a decision setting out its policy conclusions on the future operational model and objectives for the Successor Licensee to the Data Communications Company (DCC). The decision follows Ofgem's June 2025 consultation and forms part of its review of the DCC's regulatory arrangements ahead of its licence expiry in September 2027. The decision requires the new licensee to produce a Business Strategy and Technology Roadmap. It introduces a Primary Objective focused on consumer-centric service delivery and establishes three Supporting Objectives covering innovation, competition and environmental impacts, while maintaining the current approach to Fundamental Service Capability contracts. In addition, new procurement principles emphasising environmental and consumer considerations have been introduced. This decision will be followed by a consultation on the draft conditions of the Successor Licence.

Ofgem issues notice on commencement of Smart Meter Communication Licence tender process

Ofgem has issued a notice announcing the commencement of the tender process to appoint a Successor Licensee for the Smart Meter Communication Licence (SMCL), which will replace the current licence set to expire in September 2027. The process will be conducted in accordance with the Electricity and Gas (Competitive Tenders for Smart Meter Communication Licences) Regulations 2012, SI 2012/2414. Applicants will be evaluated based on technical capability, financial standing, delivery approach and alignment with regulatory objectives. Alongside the notice, Ofgem has published instructions for applicants outlining how to register on the SMCL tender platform, access documentation and submit the qualification questionnaire.
