Judgments and orders—drafting and formalities

Judgments and orders must show the date on which they were made and must be sealed by the court. Other requirements are dependent upon the type of judgment or order and the court in which it is made.

Courts may draw up orders or request that the parties do so. There are a number of court forms of orders and judgments. All consent orders are prepared by the parties.

Judgments can be given at the hearing or may be reserved to a later date. A reserved judgment is circulated to the parties

A solicitor’s file should include any instant messages for which a fee has been raised (MacInnes & another v DWF Law LLP)

Dispute Resolution analysis: In a dispute over whether solicitors were in breach of an order to disclose their entire client file to their clients in proceedings under the Solicitors Act 1974 (SA 1974), Costs Judge Nagalingam held that the firm’s failure to disclose WhatsApp messages rendered it in breach. Any items of communication for which a charge had been made necessarily formed part of the file. This included messages sent via WhatsApp, for which systems should have been in place to extract and save their contents. Written by David Juckes, barrister at Hailsham Chambers.

Nigeria wants to pursue litigation funders for £50m costs bill

Law360, London: Nigeria argued at an appeals court on 14 January 2026 that it should be able to seek to recover its £50m legal bill from the litigation funders of an oil and gas company that defrauded the West African state in arbitration proceedings.

UKJT launches consultation on AI liability under English private law

The UK Jurisdiction Taskforce (UKJT) has launched a consultation on a draft legal statement on liability for artificial intelligence (AI)-related harms under the private law of England and Wales. UKJT is seeking views on whether existing common law principles provide sufficient legal clarity on liability for physical and economic harm caused by AI, in circumstances where there is no AI-specific civil liability regime. The consultation closes on 13 February 2026.
