THIS PRACTICE NOTE HAS BEEN UPDATED IN LINE WITH SI 2014/867, PUBLISHED ON 2 APRIL 2014. April 2014 sees a number of changes to the CPR rules and practice directions over a number of different dates. Here, we set out a quick summary followed, for convenience, by the CPR changes in table format so the date on which changes occur are clear. The changes are made under SI 2014/407 unless stated otherwise. The SIs coming into force There are currently four SIs which are bringing changes to the CPR into force. It is anticipated that there will be a further one to deal with the new 28 day extension of time by party agreement to enable this new

This Practice Note sets out a summary of the upcoming CPR changes. The new provisions come into force on 5 and 6 April 2015. The main change occurs with the new Part 36 and consequential changes to costs rules. Other changes are seen in relation to children and protected parties, transfer of proceedings, judicial review and fixed costs. The changes also implement provisions within the Criminal Justice and Courts Act 2015, s 84 and 87 dealing with judicial review. The changes are set out in SI 2014/3299 and making document as well as SI 2015/670 for which the making document is not yet available. We are in the process of amending our content where relevant. The amendments to the Civil Procedure Rules (CPR) came into force on Sunday, 1 October 2017. The three Making documents came into force on the following dates: • 89th update: 8 August 2017 • 90th update: 8 August 2017 • 91st update: 31 August 2017 In relation to the pilot schemes these came into force on the following dates: • Practice direction 51Q—The County Court advisers pilot scheme. This applies to claims started in the County Court Business Centre and the County Court Money Claims centres (CCMCC) since 29 July 2017. There are a number of changes to the Civil Procedure Rules taking effect in the period 14 December 2011 to 6 April 2012, as follows: Amendments effective 1 January 2012—Dilapidations Protocol With effect from 1 January 2012 a new pre-action protocol for dilapidations claims was introduced and, with it, amendment to the Practice Direction - Pre-action Conduct in order to make reference to the new protocol. The Dilapidations Protocol applies to commercial property situated in England and Wales and relates to claims for dilapidations against tenants at the termination of a tenancy. It includes (at Annex A) a timetable for the exchange of schedules of dilapidations and responses and envisages negotiations and quantification of

Underlying documents The Civil Procedure (Amendment) Rules 2016, SI 2016/234 sets out the changes to the Parts of the CPR. The Making Document, circulated by the Ministry of Justice on Thursday 25 February 2016, sets out changes to the practice directions. Coming into force date February 2016 • 23 February 2016—changes to CPR PD 12 dealing with Default Judgment. The amendments deal with the coming into force of the Hague Convention on the Choice of Court Agreements last year • 23 February 2016—changes to CPR PD 74A dealing with Enforcement of judgments in different jurisdictions.
