PRACTICE NOTES
This Practice Note explains the purpose of a reserved judgment and the restrictions attached to the receipt of a draft judgment. It also addresses what a party should do on receipt of a draft judgment and the limited circumstances in which it may be possible to prevent a draft judgment being handed down altogether. What is a reserved judgment? A court can reserve judgment by deferring giving its reasons for making a decision to a later date in writing (as opposed to giving its judgment orally straight after the hearing or trial concludes). At the end of the hearing the judge will usually state that judgment is being reserved and will subsequently circulate a draft written judgment to the parties. This practice originated in the Court of Appeal, and was extended to the High Court. Where judgment is to be reserved, the judge may, at the conclusion of the hearing, invite the parties’ legal representatives’ views about the arrangements made for the handing down of the judgment (CPR PD 40E, para 2.1). The Commons Library has issued an updated briefing on reserved matters—policy areas that remain under Westminster’s control despite extensive devolution to Scotland, Wales and Northern Ireland. Since the Wales Act 2017, all three devolved legislatures operate under a 'reserved powers' model: everything not expressly reserved to the UK Parliament is presumed devolved. The paper reviews the historical development of this model, the continuing divergence between the devolved settlements, and the role of the Supreme Court in defining constitutional boundaries.

Practice Compliance analysis: As part of its Immigration and Asylum Bill, which had its second reading in Parliament on 13 July 2026, the government has included proposals that would substantially reform the transparency in supply chains regime under section 54 of the Modern Slavery Act 2015 (MSA 2015). If passed, the measures would introduce mandatory reporting topics, extend the regime to parts of the public sector, impose a fixed publication deadline and enable financial penalties for non-compliance. Taken together, the proposals represent a substantial reshaping of section 54 moving away from a relatively flexible, disclosure-based model and towards a strict compliance regime.
