NEWS
Local Government analysis: The Court of Appeal clarified the limits of personalised housing plans under Part 7 of the Housing Act 1996 (HA 1996), holding that they cannot include steps directed towards securing allocation of social housing under HA 1996, Pt VI. The court emphasised the statutory distinction between homelessness functions and housing allocation schemes, confirming that allocation decisions must be governed exclusively by the authority’s HA 1996, Pt VI allocation scheme. While advisory or practical assistance connected to HA 1996, Pt VI applications may in some cases fall within HA 1996, Pt VII duties, authorities are not required to include steps aimed at obtaining or prioritising social housing. The decision provides important guidance on the lawful scope and content of personalised housing plans for housing practitioners and local authorities.
